This publication explains the Yellow Expedited Direct Value-Added services and the rules and conditions of service for the United States, Alaska, Hawaii, Canada, Mexico and Puerto Rico that apply on shipments moving under other publications, pricing agreements or individual customer contracts, which show YFSY 117 as a governing publication. Exceptions to any of the items in this publication will be noted in customer-specific pricing agreements or contracts that apply for individual Yellow customers.

Rates Application, Item 150-5
The most-current version of YF40000 for intra-United States, YF40000 for Canada to the United States or the United States to Canada, and YF40000 for Mexico to the United States or the United States to Mexico will be used as the rate base for all shipments moving under Expedited Direct in the absence of a specifically stated base rate publication in this publication or other pricing agreements or customer contracts. The charge for Expedited Direct shipments will be based on the amount quoted, provided the bill of lading information corresponds to the quote information, including the shipment dimensions and weight. Should Expedited Direct quote information differ from the actual bill of lading information, a new quote will be prepared and applied to the shipment. Freight as described on the bill of lading is subject to validation through the Yellow Weight and Research program.

Quoted prices are in U.S. dollars and are based on shipment information provided at the time of the quote and on pricing programs in place for the party requesting the quote. Actual invoiced charges will be based on freight characteristics as described on the bill of lading and on pricing programs in place on the date of the shipment for the responsible pay party as identified on the bill of lading. As a result, invoiced charges and quoted charges may not always agree.

If you choose to use a Yellow shipment document other than the Expedited Direct shipping document supplied by Yellow, you must prominently show the words "Expedited Direct" on that document or have an Expedited Direct sticker on that document to receive Expedited Direct service. If you elect not to use the Expedited Direct shipping document, any document used shall be deemed to read as the Uniform Straight Bill of Lading as set forth in the NMFC 100 Series in effect at the time of shipping. In the event of conflicts or inconsistencies between the bill of lading and the terms and conditions set forth in this YFSY 117, the terms and conditions contained in this YFSY 117 shall govern. If the customer does not identify a requested delivery date on the bill of lading, the fastest Expedited Direct service date published will be provided. Shipments requiring delivery before 5 p.m. will be subject to additional charges.

As used herein, "Provider-Network" shall mean any shipment that moves partially or entirely outside the Yellow shipping network and "Yellow-Network " shall mean any shipment that moves entirely inside the Yellow shipping network. All shipments tendered for transport are subject to inspection. By tendering cargo to Carrier, Shipper grants consent to such an inspection.

Exchange Rates, Item 615
Unless otherwise indicated, all quotes, rate bases, charges, surcharges, fees, credits, liability limitations or other references to monetary amounts shall be deemed stated in U.S. dollars. Yellow will determine the exchange rate, if applicable, on the date the shipment originates.

Payment of Charges, Item 720

Credit Policy

  1. Payment of shipping charges.
    1. Shipping charges must be paid within 15 calendar days (including holidays) after the invoice date unless credit beyond these terms has been extended. The conditions of credit review and extension are outlined in Section 2.
    2. Failure to pay shipping charges within the credit terms will cause Yellow to suspend or cancel an account's credit and make that account subject to the cash-only provisions outlined in Section 1c, or the failure to pay provisions outlined in section 3.
    3. Payment as a condition of pickup or delivery will be required from accounts without approved credit or from accounts which have not previously paid within credit terms. An exception to this rule will be allowed at Yellow discretion after a review of an account's credit-worthiness. The conditions of credit review and extension are outlined in Section 2.
    4. Checks received for payment that are returned by the bank because of insufficient funds will be assessed a fee of $35 and placed with a collection agency subject to the provisions of Section 3.
    5. Pending or unfiled claims against Yellow for loss, damage or overcharge dollar amounts may not be deducted from shipping charges billed to the claimant (the party who filed or will file the claim or claims).
    6. Unpaid shipping charges are subject to civil suit.
  2. Credit review and extensions.
    1. Extension of credit beyond the terms and conditions outlined in Section 1 is a privilege offered by Yellow to qualified accounts. Accounts that desire credit and/or a credit extension must submit a credit application to the Yellow Credit Department. Credit applications can be obtained online or through Account Managers, the Customer Service Center or the Credit Department.
    2. Qualification for credit and/or credit extension will be based on an account's credit history, payment practices and financial strength. Accounts must be able to demonstrate their credit-worthiness to the satisfaction of Yellow Transportation.
  3. Charge for failure to pay shipping bills.
    1. Shipping bills that are not paid before Yellow contracts the services of a collection agency, attorney or other authorized agent will be subject to an additional charge of 35 percent of the unpaid portion of the shipping bill.
    2. Yellow will provide written notification of the intent to assign unpaid shipping bills to an outside agency, attorney or authorized agent. This notification will include a summary of the unpaid balance and the applicable fee.
    3. The charge will be assessed 10 calendar days after the written notification.
    4. Unpaid shipping bills are subject to civil suit in the Courts of the state of Kansas, county of Johnson.
  4. In the event of a problem with service, the customer has 45 days from the invoicing date to file a claim in writing. This can be accomplished by calling 1-800-610-6500, ext. 7878. Claims not filed within 45 days from the invoicing date shall not be waived.

Yellow reserves the right to suspend certain service levels and to reject a service request when the requested service cannot be reasonably performed.

Collection of Charges, Item 429

Assignment of Payment Responsibility
When payment for shipping charges is to be collected from a party other than the shipper on the bill of lading, the shipper, acting as an agent for the other party, must clearly indicate the shipment is "collect" to the consignee or indicate the name and address of the third-party Bill To (see example) on the bill of lading.

Example:

Collect and third-party Bill To requests will be accepted only when the shipper has established credit with Yellow and guarantees to pay all charges if the consignee or third-party fails to remit payment for the shipment. Bill To or third-party billing requests will be accepted on destination interline shipments on a prepaid basis only; Yellow will not accept Bill To or third-party billing requests on collect destination, interline shipments.

Shipments subject to the provisions of this item will not be accepted if the shipper executes Section 7 of the bill of lading. If a shipment is inadvertently accepted with Section 7 signed, the signing of Section 7 will not be applicable, and the shipper will remain liable for all shipping charges.

Yellow agrees to invoice shipping charges and related services to point of origin on prepaid bills and point of destination on collect bills. Third-party billing is allowed to U.S. or Canadian addresses only. Third-party billing to Mexico or international addresses will not be accepted.

When the third-party shown on the freight bill is the shipper's invoice mailing address or pay/audit agent's address, the shipment must move prepaid. When the third-party shown on the freight bill is the consignee's invoice mailing address or pay/audit agent's address, the freight must move collect.

When the third-party shown is a paying or auditing agency, the responsible pay party's name should be included before the name of agency (e.g., ABC Supply Company c/o Agency Name). If the bill of lading does not show this information correctly, Yellow reserves the right to automatically add the shipper's name before the agency's name on a prepaid bill and the consignee's name before the agency's name on a collect bill.

Should Yellow inadvertently accept a shipment where the shipper and third-party on a prepaid bill or the consignee and third-party on a collect bill have not established credit or have lost credit privileges, Yellow will contact the shipper, consignee or third-party to try to make other payment arrangements. If Yellow is unable to reach an acceptable payment arrangement, Yellow reserves the right to change the bill to collect and remove the third-party billing request, thereby making the consignee responsible for payment of all transportation charges. If the consignee is unable or unwilling to pay the charges that are due, Yellow will place the shipment in an "on-hand" status at the destination and notify the shipper. The shipper (or ultimate pay party) will be responsible for any storage charges that are incurred while the shipment is being held at destination.

Chargeable Weight Determination, Item 1502

Shipping charges are determined by multiplying the applicable rate of each article by the chargeable weight of each article. Chargeable weight is the greater of the actual or dimensional weight. Dimensional Weight is calculated by multiplying length by width by height of each package (all in inches) and dividing by 194. If the dimensional weight exceeds the actual weight, charges based on the dimensional weight will be assessed.

The dimensions of each piece are added and inserted into the dimensional weight formula to obtain total dimensions for the shipment. The total dimensional weight of the shipment is then compared to the actual weight of the shipment. If the dimensional weight exceeds the actual weight, the dimensional weight is billed.

Pickup and Delivery, Item 750
Rates in publications, pricing agreements and customer contracts referencing this publication include one pickup and loading and one delivery and unloading by Yellow or its Service Provider during business hours subject to the following provisions.

  • Placement of Vehicle for Loading: At the shipper's request, Yellow or its Service Provider will furnish and place a vehicle at the loading site designated by the shipper to pick up a shipment tendered for transportation.
     
  • Placement of Vehicle for Unloading: The delivery of a shipment by Yellow or its Service Provider to the place of delivery specified on the bill of lading will include the placing of a vehicle at the delivery site designated by the consignee.
     
  • Loading by Yellow or its Service Provider: Shipments tendered for loading shall be situated by the shipper to be directly accessible to the vehicle or it shall be immediately adjacent to a parking space suitable for Yellow or its Service Provider to place its vehicle for loading. Loading includes stowing and counting of the shipment in or on the Yellow or its Service Provider's vehicle. Yellow or its Service Provider will furnish one man per vehicle for loading. Special equipment that is needed will be at the shipper's expense.
     
  • Unloading by Yellow or its Service Provider: Shipments will be unloaded at the delivery site immediately adjacent to the delivery vehicle. Unloading includes the counting and removal of the shipment from the position in which it is transported in or on the Yellow or its Service Provider's vehicle. (See Inside Pickup or Delivery, Item 566.) Yellow will furnish one man per vehicle for unloading. Special equipment that is needed will be at the shipper's expense.
     
  • Sorting and Segregating: Loading or unloading service does not include assembling, packing, unpacking, dismantling, inspecting, sorting or segregating shipments except as provided below: When a shipment is tendered to Yellow or its Service Provider in lots according to size, brand, flavor, or other characteristics and is so identified on the bill of lading or accompanying papers, normal delivery of the shipment to the consignee in the same manner, including the placement of such sorted or segregated lots on the platform, dock, or similar device provided by the consignee for the receipt of shipments within or adjacent to the vehicle without additional charge to the extent such service is performed within the free time period allowed by the applicable detention provisions. If the delivery is not completed within the allowable free time, Yellow or its Service Provider will continue to unload the vehicle subject to the applicable detention charges.
    Loading or unloading service does not include rigging or special loading or unloading equipment, such as platform vehicles (other than two-wheeled hand trucks), winches, cranes, jacks or other special equipment used in hoisting, lowering, handling or placing shipments in position. When such equipment is used in loading or unloading, the shipper or consignee, as the case may be, shall furnish this equipment and the necessary labor to operate such equipment at its expense and shall also assume responsibility for safe loading or unloading except the Yellow or its Service Provider's employee may use hand trucks or four-wheeled hand carts and hand or electrically operated pallet jacks (non-riding type) when furnished by the shipper or consignee.
     
  • Loading by Shipper or Unloading by Consignee: The shipper or consignee may elect to waive the loading or unloading of shipments by Yellow or its Service Provider by performing at its own expense the loading or unloading of the shipment on or from the Yellow or its Service Provider's vehicle.
     
  • More Than One Loading or Unloading Site: At the request of the shipper or consignee, pickup or delivery service may be performed at more than one loading or unloading site within the continuous plant property or premises, provided the sites are not intersected by more than one public thoroughfare.
     
  • Heavy or Bulky Freight Loading or Unloading: When a shipment (per package or piece) in a single container, or secured to pallets, platforms or lift truck skids, or in any other authorized form of shipment:
    • Weighs 110 pounds or less, Yellow or its Service Provider will perform the loading and/or unloading (see Exceptions).
    • Weighs more than 110 pounds but less than 500 pounds, Yellow or its Service Provider will perform the loading and/or unloading where a dock, platform or ramp is directly accessible to the vehicle.
    • Weighs 500 pounds or more, the shipper or consignee will perform the loading or unloading. On request, Yellow or its Service Provider's driver will assist in loading or unloading.

Exceptions:
Regardless of weight, if there is no dock, platform or ramp provided, the shipper or consignee will be responsible for loading or unloading. On request, Yellow or its Service Provider's driver will assist in loading or unloading.

Shipments shall be considered to be immediately adjacent to a space suitable for Yellow or its Service Provider to place its vehicle for loading or unloading if separated only by an intervening public sidewalk. If a parking space suitable for Yellow or its Service Provider to place its vehicle for loading or unloading is occupied or city ordinance prevents its use, the nearest available parking space may be used.

On shipments requiring delivery to exclusive agents, Yellow or its Service Provider will consider tender to the agent as delivered.

Special Pickup, Item 750-9
Rates are applicable for shipments ready for pickup by 7 p.m. local time and called in at least 2 hours in advance of the necessary pickup time on the day service is required. Shipments requiring pick up between 5 p.m. and 7:59 a.m. local time will be assessed a $75 surcharge. Shipments requiring pickup after 7 p.m. local time are subject to move on the next days' service.

Precedence of Rates and Charges, Item 765

Application of Pricing
When the shipper, consignee or third party has a pricing agreement or contract with rates applicable to its linehaul charges on a given shipment, those provisions applicable to the payer of the freight charges will apply. This priority or application will apply whether the total charges are higher, lower or unchanged from those that might result if provisions applicable to a nonpaying party were applied.

Payer shall mean:

  • The shipper on prepaid shipments (except when a third party has been designated on the original bill of lading).
  • The consignee on collect shipments.
  • A third party (party other than shipper or consignee) as designated on the original bill of lading. Shipment payment plans will not be considered as payer.

When business-to-business transportation service is not enough, Yellow is poised and ready to provide the additional transportation-related services necessary to meet your needs and the needs of your customers. A list of our standard value-added services is below under Rules and Conditions of Service. Precedence of Service, Item 160

When two or more service directives are indicated on a single bill of lading, Yellow will rate and route the shipment via the service directive that provides the most expedited, precise, in-network delivery option. For example, Exact Express® will take precedence over Definite Delivery® if both services are marked on a single bill of lading.

The following are certain rules, exceptions to NMFC items, and conditions of service that apply for shipments handled by Yellow Expedited Direct. Any exceptions to these provisions will be noted in customer-specific pricing agreements or contracts that apply for individual Yellow customers.

Shipment Charges

Absolute Minimum Charge, Item 610
Unless otherwise provided, the base-rate minimum charge applicable to any shipment will be no lower than $95 for Next Day, $85 for Second Day and $80 for Third Day. For shipments originating from or destined to the contiguous United States that are destined to or originating from Hawaii, Alaska, Mexico or Puerto Rico, the linehaul minimum charge applicable to any shipment will be no lower than $150. For shipments originating from or destined to the contiguous United States that are destined to or originating from Canada, the linehaul minimum charge applicable to any shipment will be no lower than $120. (Exact Express Dedicated Equipment shipments are excluded.)

Advancing Charges, Item 300
Charges that are incidental to the transportation of the shipment are the only charges that will be advanced to shippers, owners, consignees or agents. The nature of the charges to be advanced must be stated on the bill of lading at time of shipment.

This item does not include the advancing of broker's fees on inbound shipments moving from a place in a foreign country to another place in a foreign country and transported through the United States.

Attempted Pickup/Delivery, Item 750-1
When Yellow or its Service Provider attempts to make the pickup or delivery of a shipment and the service is denied, a $75 charge per shipment incidence will be applied. Shipments  that cannot be delivered because of the consignee's refusal or inability to accept it will be subject to a surcharge of $75 and any applicable storage or detention charges.

Beyond Charges/Rural Charges & Interlines, Item 1500
Extended service charges will not apply on certain ZIP codes as defined as an A, B or C point per YELL 2011 Item 800. All points defined as a D point in YELL 2011 Item 800 will be assessed $0.03 per pound with a $20 minimum and $500 maximum. All points defined as an E or F point in YELL 2011 Item 800 will be assessed $2.00 per mile with a $75 minimum. All points defined as a G, H or Y point in YELL 2011 Item 800 will be assessed $2.15 per mile with a $75 minimum. For points E, F, G, H or Y, the mileage will be calculated from the servicing airport to the location tendering or receiving the shipment.

Bills of Lading, Item 360-2

Terms
All shipments Yellow accepts shall be regarded as being bound by the terms and conditions of the Uniform Straight Bill of Lading as stated in the NMFC 100 series tariff. Any bill of lading, receipt, form or other shipping document used for goods transported by Yellow or its agent, if not the Yellow bill of lading form, shall be deemed to read as the Uniform Straight Bill of Lading noted above. A Yellow driver's or its agent's signature for goods on the bill of lading, receipt, form or other shipping document shall not constitute an acceptance of any terms or conditions that vary from Yellow terms and conditions of service provided in its applicable tariffs and other publications or the Uniform Straight Bill of Lading terms and conditions.

Payment terms will be considered prepaid when not otherwise indicated on the bill of lading document.

Freight Bills and Statements of Charges
Section 2 (a) of NMFC 100 item 360 does not apply and is replaced with the following:

Sec. 2 (a) - The name, address and 5-digit ZIP code of only one shipper and one consignee and only one destination shall appear on a bill of lading. Bills of lading for shipments consigned "To Order" at one point, with instructions to notify the consignee at another point, will be permitted only when both points are adjacent or in the same commercial zone.

Bills of Lading—Corrected, Item 362

Shipment Charge Collection Status
Before delivery of a shipment, changes in the collection status (prepaid or collect) of a freight bill will be permitted on receipt of a corrected bill of lading or other written instructions from the shipper. After a shipment has been delivered, written authorization for reversal of charges, or any other change, must be furnished by the party assuming responsibility for payment. A Letter of Authority (LOA) from the shipper or the responsible paying party will be accepted and treated as a Corrected Bill of Lading.

After payment has been received based on the terms of the original bill of lading, reversal of payment terms or changes in responsible pay party (including third party changes) will not be accepted.

The charge for changing the payment terms or the party responsible for payment of a shipment bill will be $15.

Shipment Description or Weight
Changes in description or weight will be permitted when Yellow is presented satisfactory proof (such as original invoice and descriptive literature) that the original bill of lading was in error.

Collect on Delivery (COD) Shipments, Item 430
Yellow can handle collect on delivery (COD) shipments that are tendered on "Uniform Straight", "Straight Bill of Lading Short Form" or "Straight" bill of lading forms. All checks (including cashier's checks and certified checks) and money orders tendered in payment of COD shipments will be accepted by Yellow at the shipper's risk, including, but not limited to, the risk of non-payment and forgery; Yellow will not be liable upon any such instrument. Unless the shipper writes instructions to collect "Cash Only" in the COD section of the Bill of Lading, Yellow will accept the consignee's check naming the shipper as payee in payment of the COD package. When instructions to collect "Cash Only" are indicated, Yellow reserves the right to accept cash, cashier's check, certified check, money order or similar instrument issued by or on behalf of the consignee. If, for any reason, COD payment is refused by the consignee, Yellow is responsible only for the disposition of the shipment in accordance with the bill of lading contract. Yellow is not responsible to seek or remit the COD amount to the shipper or owner of the goods. All COD payments will be sent to the shipper's address shown on the bill of lading unless other instructions are provided or written notice is received in time to effect a change.

The charge for collecting and remitting each COD will be $50. A charge of $30 per shipment will be assessed for increasing, reducing or canceling the COD amount or for changing the remittance address and will apply in addition to any applicable COD collection fee. COD charges will be payable by the consignee unless the shipper authorizes on the bill of lading the charge to be prepaid.

All freight charges due Yellow should be paid separately and not be included in the checks or money orders made payable to the shipper for the COD.

Cancellations, Item 1560
Shipments may be canceled by either party upon telephone or written notice with said cancellation effective as soon as communicated to the other party. Cancellations directed by the customer will be subject to an administrative cancellation fee of $50 per shipment. In addition, all charges and expenses incurred before cancellation shall be paid by the customer.

Customs or In-Bond Shipments, Item 480
Shipments moving under United States Customs Bond (including T&E and TIB bonds) for U.S. Customs clearance will be subject to additional charges  of $1.60 per 100 pounds, subject to a minimum charge of $85.45 and a maximum charge of $178.

Base rate charges on shipments requiring U.S. Customs clearance at a point other than the final destination will be contracted and assessed on a combination of rates and charges over the point of U. S. Customs clearance. Combination of rates and charges will not be assessed when the ultimate consignee is within 25 miles of the point of U.S. Customs clearance.

Shipments moving in-bond may not be included in the same shipment on the same bill of lading with shipments not moving in-bond.

Shipments waiting U.S. Customs clearance will be subject to detentions charges (also see Wait Time/Detention, Item 500, or Storage Charges, Item 910). Any detention or storage charges will be assessed against the shipper on export shipments and against the consignee on import shipments. For the purpose of applying storage rules and charges in connection with shipments moving under U.S. Customs Bond, notification to the Deputy Collector of Customs that a shipment is available for customs inspection will constitute tender of shipment for delivery.

Each Immediate Transportation (I.T.) Permit issued for movement of an in-bond shipment will be considered as a separate shipment and must be accompanied by one bill of lading and shipping order. The provisions of this paragraph will not apply to truckload shipments moving in-bond between steamship company piers or wharves or when such shipments are delivered to a U.S. Customs Bonded Warehouse.

On shipments cleared in-route by U.S. Customs, and movement beyond such clearance does not require a seal, normal rates and charges will apply to the beyond point.

When necessary for Yellow to buy and apply "High Security Red In-Bond Seals" for shipments moving under U.S. Customs Bond, a charge of $36 per seal will be assessed. Yellow will not be responsible for equipment or tools necessary for removal of High Security Red In-Bond Seals.

Customs charges on shipments of alcoholic liquors will not apply when the shipment is consigned to a U.S. Customs Bonded Warehouse, and Yellow is not requested to clear shipment through U.S. Customs. The following certification must be shown on the bill of lading:

"This is to certify that Yellow is not required to clear shipment while in their possession."

Shipment Export/Import Requirements at the U.S.-Canadian/Mexican Borders, Item 550-8
Shipments must be accompanied by all papers necessary to comply with the requirements of governmental authorities.

Shipper must furnish all invoices, document evidence and declarations, including duties, fees and other charges, which may be imposed or assessed against the property transported. Yellow will not be responsible for delays to the goods transported nor for goods held by any government for any reason. Where all necessary requirements of such authorities are not complied with and, through no fault of Yellow, expenses are incurred, such expenses will be advanced by Yellow and will be billed to the party responsible for paying the freight charges. Delivery will not be made until such charges are paid or guaranteed by shipper or consignee.

When shipments must be held by Yellow, pending compliance of custom's regulations, a charge will be made for the following services required on the part of Yellow:

  • Unloading, handling and loading: $1.07 cents per 100 pounds, with a minimum charge of $6.33.
     
  • Storage: $0.83 cents per 100 pounds per day subject to a minimum charge of $4.29 per shipment per day, but in no case less than $15.10 per shipment.
     
  • Fractions of a day will be considered as one day, and fractions of 100 pounds will be considered as 100 pounds.

For the purpose of this rule, the customs broker will be deemed to be the agent of the shipper and/or the consignee.

Hazardous Materials or Explosives
Hazardous material or explosives cannot be moved as Expedited Direct. For a quote on a service that can move hazardous material please call the customer service center at 1-800-610-6500, option 4.

Hotel, Mall, Hospital, School and University Delivery—Ex-network only, Item 617
In the event that a pickup or delivery is made to a Hotel, Mall, Hospital, School or University, and the shipment must move outside the Yellow network, a charge of $6.00/cwt is applicable subject to a minimum of $17.50.

Inside Pickup/Delivery, Item 566
Yellow or its Service Provider can move shipments from or to positions beyond loading or unloading areas at the shipper or consignee's request. Inside pickup or delivery service will be provided to floors above or below the level accessible to Yellow or its Service Provider's vehicle only when elevator or escalator service is available and labor necessary to operate it is provided without cost to Yellow or its Service Provider.

Service will be provided at a charge of $0.05 per pound or subject to a $25 minimum charge. Unless the bill of lading is marked "inside delivery prepaid," charges are payable by the party who requires the service.

Over-Dimension Shipments, Item 622
An additional charge of 30 percent of the base amount or $140.00, whichever is greater, will be assessed to any shipment containing one or more articles with any one dimension exceeding 59 inches or 300 pounds per piece or 5,000 pounds per shipment. Shipments cannot contain one or more article with a length exceeding 118 inches or 84 inches in width or 70 inches in height or 2,200 pounds per piece, or 7,000 pounds per shipment or 213 inches linear. If an article is tendered to Yellow or its Service Provider and determined by the weight and research department to exceed the above restrictions, the shipment will be rated at the Yellow published standard rate to complete the move.

Pallet Jack Pickup or Delivery, Item 1505
At times, it may be necessary to use a pallet jack to make the pickup or delivery of a shipment from Yellow or its Service Provider's vehicle because of the type of goods or where the physical delivery must be made. Neither Yellow nor its Service Providers maintain pallet jack equipment on all pickup and delivery equipment; therefore, arrangements can be made through the local Yellow Customer Service Center for the pickup or delivery of shipments requiring pallet jack service. Pallet jack service is $75 per occurrence. Pallet jack charges are to be paid by the party that requests the service.

Security Charge, Item 1506
Because of increased costs from recently enhanced security measures,  a $0.05 per pound charge with a $10 minimum (ex-net only) will apply on all Service Provider-network shipments.

Service Upgrade, Item 1550
When you need to get a shipment to the destination faster than the date on the bill of lading, our Customer Service Center can upgrade that shipment to Exact Express®. There is a $200 surcharge for this service in addition to the base rate part of the shipment before and after the upgrade. Also, a letter of authorization is needed from the paying party to finalize the shipment. Please dial 1-800-610-6500, option 4, to engage this service.

Trade Show, Item 755
An ex-network shipment of exhibition or trade-show material and paraphernalia, including exhibition booths or stalls, will be assessed an additional charge of $0.02/lb with a minimum additional charge of $25 and a maximum additional charge of $250. Saturday pickup/delivery and after-hours pickup/delivery charges do not apply to trade show shipments for customers using tariff.

Undelivered Shipments, Item 345
Shipments that cannot be delivered because of the consignee's refusal or inability to accept it will be subject to applicable storage or detention charges.

By-Noon Delivery, Item 150-6
When a customer requests that a shipment be delivered by noon, an additional charge of 25 percent of the base amount will be applied. By-noon shipments are only applicable to A, B and C points as defined in the Expedited Direct Service Guide YELL 2011 Item 800.

Extra Labor, Item 560
Need assistance on your dock to get shipments loaded or unloaded on Yellow or its Service Provider's equipment? We can provide the extra labor (subject to availability) necessary to help in loading, unloading or transferring a shipment at your request. The charge for extra labor is $75 per hour or fraction of hour used. Time spent by extra labor will be computed from the time the extra labor arrives at the work site until the loading or unloading is complete. The charges will be paid by the shipper if extra labor is used for loading and by the consignee if the extra labor is used for unloading.

Fuel Surcharge, Item 190
We adjust the Expedited Direct surcharge on Thursdays, based on the U.S.G.C. Jet fuel index.

Lift-Gate Service, Item 520
At times, it may be necessary to use a hydraulic lift gate to make the pickup or delivery of a shipment from Yellow or its Service Provider's vehicle because of the type of freight or where the physical delivery must be made. While Yellow or its Service Provider is not obligated to perform lift-gate service and does not maintain lift-gate equipment at all our service centers, arrangements can be made through the local Yellow Service Center for the pickup or delivery of shipments requiring lift-gate service. Lift-gate service is $89.95 per occurrence. Lift gate charges are to be paid by the party that requests the service.

Notification-Before-Delivery Service, Item 485-8
When your customer needs to know when a shipment will be delivered, Yellow is ready to assist by notifying the consignee, or any other party, before the shipment is delivered. The charge for notification service is $10 per shipment. Unless Notify-Before-Delivery Service is requested prepaid on the bill of lading, charges are payable by the party that requests the service.

Order Consolidation, Item 618
When a customer requests an order be consolidated, and the shipment is moving outside the Yellow Transportation network, a charge of $0.80/piece with a minimum of $75 will be applicable.

Proof of Delivery, Item 150-8
Proof of delivery is available on www.myyellow.com at no charge. Customers must register for MyYellow to use this tool. For customers who request a hard copy, there will be a $10 fee.

Redelivery, Item 830
What happens when you or your customer cannot accept delivery of a shipment tendered for delivery by Yellow or its Service Provider? Yellow or its Service Provider can help by making a redelivery of the shipment on your request. Redeliveries generally occur when the initial delivery cannot be accomplished for reasons beyond Yellow or its Service Provider's control. The charge for each redelivery is $.06 per pound with a $60.00 minimum and $650.00 maximum.

Residential Pickup/Delivery Service, Item 753
When Yellow makes a pickup or delivery at any non-commercial or private location, including commercial establishments or businesses that are not open to the walk-in public during normal business hours, an additional charge of $75 will apply. This applies to locations, such as apartments, camps, churches, farms, mini-storages and other locations. The additional charge includes initial notification for delivery arrangements but does not include inside delivery service or any subsequent notification. Unless the bill of lading is marked residential delivery prepaid, charges are payable by the party who requests the service.

Sorting and Segregating, Item 751
Normal loading or unloading service performed by Yellow does not include sorting or segregating freight. Shipments that require sorting and/or segregating will be subject to a charge of $0.80 per piece or $75 per shipment, whichever is greater. Charges are payable by the party that requires the sorting and segregating service.

Storage Service, Item 910
When Yellow or its Service Provider is providing storage services, liability is that of a warehousemen instead of a common carrier. Charges for shipments stored in the possession of Yellow or its Service Provider are $1.50 per 100 pounds per day for each day the shipment is stored with a minimum charge of $50 per shipment or a minimum charge of $2 per pound per day and a maximum charge of $115 per shipment per day. Unless otherwise authorized, storage charges will be included on the disposition freight bill following the payment terms of that shipment. Storage charges for freight stored in a public warehouse will be advanced by Yellow or its Service Provider for payment. Charges must be paid or guaranteed before the service will be performed.

Trade Show, Item 755
An Expedited Direct shipment of exhibition or trade-show material and paraphernalia, including exhibition booths or stalls, will be assessed an additional charge of $0.02/lb with a minimum additional charge of $25 and a maximum additional charge of $250. Saturday pickup/delivery and after-hours pickup/delivery charges do not apply to trade show shipments for customers using tariff.

All trade show shipments will also be subject to Weight Verification as outlined in Item 992, Sec. 2, Weight Determination or Verification.

Wait Time/Detention, Item 500
Detention applies when Yellow or its Service Provider's trailers with tractors or power units are delayed or detained (through no fault of Yellow) either on the premises of the shipper or consignee or as close thereto as the conditions will permit.

If the loading or unloading of freight is delayed beyond one hour of free time, a charge of $75 per vehicle for each hour or fraction thereof will be made for the time consumed for the delay.

Free time will begin when Yellow or its Service Provider's driver notifies a representative of the shipper or consignee of the arrival of the trailer for loading or unloading. Time will end on completion of loading or unloading and receipt by the driver of a signed bill of lading or receipt of delivery.

When the loading or unloading of a vehicle cannot be completed at the end of a normal business day, shipper or consignee may request that the trailer without the tractor remain at its premises or they may request that the vehicle be returned to the Yellow or its Service Provider's terminal. That portion of the shipment in Yellow or its Service Provider's possession is subject to storage charges. The portion of the shipment that is redelivered is subject to a redelivery charge.

Unless the shipper stamps or marks delivery receipt with time of arrival and departure, Yellow or its Service Provider records will be used to determine free time.

In the case of multiple shipments received from one shipper or delivered to one consignee at one time in one vehicle, free time will be computed on the aggregate weight of the multiple shipments received or delivered. Where either a single shipment or such multiple shipments exceed the capacity of one vehicle, free time for each vehicle will be computed separately.

Weight Determination or Verification, Item 992

  1. At the shipper or consignee's request, or as determined by Yellow or its Service Provider's Weight and Research Department, Yellow or its Service Provider will weigh any shipment or vehicle on its scales and will correct the billed weight accordingly. If the bill of lading is found to be incorrect, Yellow will adjust the billed weight and recalculate charges on the adjusted billed weight. This includes any bill of lading that does not include a weight. Yellow or its Service Provider will only weigh shipments while they are in its possession. When Yellow or its Service Provider is requested to use a certified public scale to reweigh any shipment or vehicle, the fee assessed to Yellow or its Service Provider will be advanced for payment to the party requesting the weight verification. The charge for weighing is $15 per shipment or vehicle. The charge will be added per the terms of the original bill of lading.
     
  2. Application to Tradeshow shipments: all goods, including exhibition material and paraphernalia, including exhibition booths, in addition to all other charges, when being shipped to a trade show as the final destination or from a trade show location will be subject to a Weight Verification charge of $15.00 per shipment or vehicle . Weight Verification will be performed on all trade show shipments regardless of weight notations recorded on the original bill of lading. Also see Item 755, Trade Show Service.

Limitations of Liability, Item 780-1

Special Damages | Force Majeure | Provider Network | Yellow Network | Liability for Mexico | Notes | Liquor

As used herein, "Provider Network" shall mean any shipment that moves partially or entirely outside the Yellow shipping network. "Yellow Network" shall mean any shipment that moves entirely inside the Yellow shipping network.

Special Damages
Yellow or its Service Provider shall not be liable for consequential, incidental, special, punitive, exemplary, economic or similar damages of any kind or nature, however caused and on any theory of liability, even if Yellow or its Service Provider has been advised of the possibility of such damages.

Force Majeure
If, and to the extent that Yellow or its Service Provider may be precluded by Acts of God, authority of law, strikes, lockouts, casualties, adverse weather conditions, governmental action or regulation, acts of terror, or other cause beyond Yellow or its Service Provider's control from the performance hereunder, such performance shall be excused to the extent that it is necessitated by such causes, including the service guarantee.

Provider Network Shipments (see notes 1 through 5)
The Yellow liability for loss, damage, injury, or delay to cargo for shipments moving in the Provider Network under the Expedited Direct program will not exceed $0.50 per pound actual weight, per package or per carton, subject to a maximum liability of $125,000 per shipment or actual value, whichever is lower.

If a shipper desires to tender a shipment requiring liability in excess of the above, Yellow will assess an additional charge of $0.70 per each $100 in excess coverage, subject to a minimum coverage charge of $37. The maximum excess liability is $125,000 per shipment and is added to the initial $125,000 in coverage for a total of $250,000 available liability coverage. Such charge is in addition to the lawful freight charges otherwise accruing to the shipment. Charges are to be paid by the party responsible for payment of the otherwise applicable freight charges. Excess liability must be requested before shipment pickup and incorporated into the shipping documents.

For claim purposes, commodities subject to "released or declared value" in the National Motor Freight Classification, Series 100 ("NMFC") shall be released to the lowest value set forth in the NMFC or its actual value, whichever is less, not to exceed the limitations stated above.

Yellow Network Shipments (see notes 1, 2, 3, and 5-9)
The Yellow liability for the loss, damage, injury or delay to cargo for shipment's moving in the Yellow Network under the Expedited Direct program will not exceed $25 per pound actual weight, per package or per carton, subject to a maximum liability of $125,000 per shipment or actual value, whichever is lower.

For claim purposes, commodities subject to "released or declared value" in the National Motor Freight Classification, Series 100 ("NMFC") shall be released to the lowest value set forth in the NMFC or its actual value, whichever is less, not to exceed the limitations stated above.

For claims purposes, all used machinery or equipment will be considered released to a value not exceeding $0.50 per pound. This applies on commodities which are used, old, scrap or having value only for reclamation, salvage, reconditioning or reconstruction. Used items which have been reconditioned and not further used before shipment will not be considered used equipment or machinery.

If a shipper desires to tender a shipment requiring liability in excess of the above, Yellow will assess an additional charge of $0.70 per each $100 in excess coverage, subject to a minimum coverage charge of $37. The maximum excess liability is $125,000 per shipment and is added to the initial $125,000 in coverage for a total of $250,000 available liability coverage. Such charge is in addition to the lawful freight charges otherwise accruing to the shipment. Charges are to be paid by the party responsible for payment of the otherwise applicable freight charges. Excess liability must be requested before shipment pickup and incorporated into the shipping documents.

Yellow Network and Provider Network Liability for Mexico (See notes 1, 2 and 4)
Yellow liability for loss, damage, injury, or delay to cargo for shipments moving under the Expedited Direct program, occurring during the Mexican part of any such transportation, will not exceed $0.50 per pound actual weight, per package or per carton, subject to a maximum liability of $5,000 per shipment, actual value, or released value as set forth in the National Motor Freight Classification (NMFC), Series 100, whichever is lower. Excess liability coverage is not available for shipments moving to or from Mexico. Excess liability coverage bought for movements in the United States and Canada shall cease during the Mexican part of any such transportation.

Note 2:
Shipments Liable To Damage Other Shipments or Equipment
Yellow is not obligated to receive shipments liable to damage other shipments or our equipment. Such shipments may be accepted and receipted for "subject to delay for suitable equipment" or may be refused for lack of suitable equipment.

Note 3:
Example:
Customer requesting $10,000 additional excess coverage would enter on the bill of lading as follows: Additional liability request in the amount of $10,000.

Note 4:
The  term "package" or "carton" used in this item means any primary shipping package authorized by the provisions of individual publications or classification items. When a number of packages or cartons have been unitized, strapped or fastened together on pallets, platforms, skids or have been over-packed in an additional complying package, the liability will be determined by separately multiplying the weight of each individual package or carton lost or damaged, multiply the number of packages or cartons using the limits specified in the applicable liability section.

Note 5:
A declared value on the bill of lading, standing alone, is not acceptable as a request for excess liability coverage. The only acceptable language for requesting additional liability coverage is in Note 3. Additional liability coverage provides coverage only to the extent of Yellow Transportation liability as a common carrier subject to federal law, the bill of lading contract and the rules and conditions of Yellow Transportation.

Requests for excess coverage shall be made as the last entry in the "Description of Articles, Special Marks and Exceptions" section of the bill of lading or such similar section if the Uniform Straight Bill of Lading set forth in the NMFC is not used. Otherwise, such requests shall be made adjacent to, but not in lieu of the "declared value" section on the bill of lading.

Any use of the word(s) insure or insurance in a request for coverage will be ignored. If a bill of lading is inadvertently accepted with language other than that specified herein, no coverage will exist. If an inadvertent charge for such coverage is made because of any wording other than referenced herein, that charge will provide only the common carrier excess liability coverage as defined in this note. In the event a request for excess liability coverage is greater than the maximum allowed, Yellow will provide coverage only for the stated maximum and assess a charge accordingly.

Liquor Shipments, Item 577-10
Shipments of any spirituous, vinous, malted or other fermented liquor, or any compound containing such contents, will not be accepted for transportation unless the packages in such shipments are accompanied by a copy of the bill of lading or other document showing the name of the consignee, the nature of its contents and the quantity contained therein (see Title 18, U.S.C., Section 1263, as amended Sept. 26, 1968).
