Item 522, Definite Delivery® Yellow Transportation guarantees on-schedule delivery before 5 p.m. local time of Definite Delivery shipments between all direct service points in the Continental United States and Canada as listed in the Yellow Service Guide. "On-schedule" delivery is determined by the Yellow service standard in effect between such points (described by ZIP or postal code) at the time of shipment. To activate this service, the shipper must clearly and legibly write or mark "Definite Delivery" (and optional contact name and phone/fax number or e-mail address) on the bill of lading, and notify the pickup driver and/or Yellow representative at time of pickup request. Net linehaul charges will be increased by a 20 percent Definite Delivery premium, subject to a $40.00 minimum charge, and will be shown on the invoice as a separate line item. In the event that Yellow does not complete delivery or tender for delivery on or before the Yellow standard service date, Yellow will cancel 100 percent of the shipment charges on customer request. Storage charges will apply to Definite Delivery shipments as per YFSY 115, Item 910. Yellow guarantees on-schedule delivery before 5 p.m. local time of Definite Delivery Window shipments between all direct service points in the Continental United States and Canada as listed in the Yellow Service Guide. "On-schedule" delivery is determined by the window dates—'do-not-deliver-before-date' (from) and 'must-deliver-by-date' (to)—requested by the customer between such points (described by ZIP or postal code) at the time of shipment. At least one of the dates must be on or after the Yellow standard service date. To activate this service, the shipper must clearly and legibly write or mark "Definite Delivery Window" and the 'from' and 'to' dates in the format "xx/xx–xx/xx" (and optional contact name and phone/fax number or e-mail address) on the bill of lading, and notify the pickup driver and/or Yellow representative at time of pickup request. Net line haul charges will be increased by a 20 percent Definite Delivery Window premium, subject to a $65.00 minimum charge, and will be shown on the invoice as a separate line item. In the event that Yellow does not complete delivery or tender for delivery within the delivery window (on the 'from' or 'to' date, or any date in between) on or before the Yellow standard service date, Yellow will cancel 100 percent of the shipment charges on customer request. The delivery window for Definite Delivery Window service can be from one to five days in duration. The delivery window must contain at least one day that is either on or after the Yellow standard service date. Saturday, Sunday, and holidays are excluded from Definite Delivery Window service. Storage charges will apply to Definite Delivery Window shipments as per YFSY 115, Item 910, except that for Definite Delivery Window shipments, storage begins on the eighth calendar day after the shipment has been received, not including holidays. Definite Delivery Billing Adjustment Requests or Definite Delivery Window Billing Adjustment Requests must be filed through the Yellow website or through Customer Service within 15 days of the shipment's originally scheduled delivery date. If the shipment charges have already been paid, then a refund will be issued in the amount of the paid charges. A shipment will be considered as "delivered on schedule" when it is available for delivery on or before the Yellow standard service date for Definite Delivery, or when it is available for delivery within the delivery window for Definite Delivery Window, but is not delivered because of: unavailability of consignee; refusal by consignee to accept shipment; inability of the consignee to pay for all charges due at time of delivery if the consignee does not have established credit with Yellow; or other circumstances controlled by the consignee that prevent delivery. For delivery date calculation, Yellow does not include day of pickup, weekends or holidays. The following types of shipments and/or commodities will not be eligible for Definite Delivery or Definite Delivery Window service: articles as listed in the Yellow Rules and Conditions Guide, Item 780; freezables (not eligible from November 1 through April 15); Poison Gas 2.3; Poison 6.1; shipments containing any single piece over 20 feet in length; shipments moving on Truckload Transportation "Spot Pricing" Agreements; shipments moving on government bills of lading. The guarantee does not apply to Definite Delivery or Definite Delivery Window shipments that are delayed because of causes beyond the control of Yellow, including but not limited to: acts of God; acts or omissions of public authority; riots, strikes or labor disputes; government regulations, orders or requirements; severe weather or other natural disasters that disrupt ground transportation networks; act or omission by shipper, consignee or owner of goods. The Yellow liability for an on-schedule delivery failure shall be limited to the cancellation of charges as provided herein, and Yellow shall not be liable for any consequential, incidental, special, punitive, economic or similar damages of any kind or nature. Yellow maintains the right to suspend Definite Delivery or Definite Delivery Window service because of severe weather or other interruptions to its ground transportation network. Terms and conditions of this service guarantee are subject to change at any time by carrier and are available on the Yellow website. |
